I. Finanzgeschäft:Recht, ein nach Preis oder Menge bestimmtes Vertragsangebot anzunehmen oder abzulehnen. Zu unterscheiden sind O. aus ⇡ Optionsgeschäften, z.B. ⇡ Devisenoption und ⇡ Aktienoption, die standardisiert an Terminbörsen oder auch individuell außerbörslich abgeschlossen werden, von O. aus ⇡ Optionsscheinen. Diese gelten rechtlich als Wertpapiere, die das Optionsrecht verbriefen.
II. Steuerrecht:Recht des Unternehmers, die Regelbesteuerung zu wählen. Wegen O. bei Steuerbefreiungen vgl. ⇡ Verzicht auf Steuerbefreiungen; wegen O. des Kleinunternehmers vgl. ⇡ Kleinunternehmer. Auch der nach Pauschsätzen versteuernde Land- und Forstwirt kann durch O. die Regelbesteuerung wählen. Eine Optionsmöglichkeit bietet sich auch im Rahmen der ⇡ Differenzbesteuerung.
- Zweck der O. ist, die tatsächlich angefallenen Vorsteuern (⇡ Vorsteuerabzug) voll abziehen zu können.
- Voraussetzung für eine wirtschaftlich sinnvolle O. ist die Überwälzung der durch die O. geschuldeten Umsatzsteuer. Literatursuche zu "Option" auf www.gabler.de
